Terms and Conditions for Enfants Nature

Enfants Nature is an entity offering guided hiking services in Mauritius. The present general conditions are concluded between :

 

– on the one hand, a person or legal entity, referred to as “the customer”, who books a service via the enfantsnature.com website, on one of the various third-party online booking platforms such as “TripAdvisor”, “MariDeal”, “Deals.mu” or any other third-party supplier, by e-mail “booking@enfantsnature.com” or by telephone.

 

– on the other hand, Enfants Nature, whose registered office is located in Chamarel. The purpose of these terms and conditions is to define the terms and conditions for booking and participating in services between Enfants Nature and the customer. They apply to all bookings of services offered on the website enfantsnature.com, as well as to the third party suppliers mentioned and any others, whether the booking is made by telephone, by post, by e-mail or directly via theEnfants Nature website (online booking). They also apply to the validation of quotations for various outings/events.

All services must be booked in advance. Any booking on the enfantsnature.com website necessarily implies that the customer has read these conditions before booking, and accepts all their contents. Acceptance of these conditions takes effect upon validation of the reservation or acceptance of the quote by the customer. Consequently, the customer acknowledges that he/she is fully aware of the fact that his/her agreement to the content of these conditions does not require a handwritten signature of this document, insofar as the customer wishes to book online services presented on the Enfants Nature website. The general terms and conditions applicable are those in force on the day of validation of the reservation or quotation by the customer. Enfants Nature reserves the right to modify the terms and conditions at any time and without prior notice.

The customer can make a reservation on the Internet via the enfantsnature.com website. The data provided by the customer and recorded by Enfants Nature at the time of the reservation constitutes proof of the transactions between Enfants Nature and the customer. The validation click (after completing the reservation form) constitutes confirmation of the customer’s reservation and constitutes an electronic signature with the same value as a handwritten signature. This constitutes irrevocable acceptance of the general terms and conditions.

 

  • In case of reservation by e-mail, mail or telephone, the reservation of the service will be effective only after receipt by Enfants Nature of the total amount of the reservation. A receipt will be issued if necessary.

  • In the case of a reservation made online by the customer (distance selling), a confirmation e-mail will be sent to the customer. Enfants Nature reserves the right to refuse a reservation or to honor a service if a customer has not paid in full at least 48 hours before the scheduled date of the outing or event.

 

Computerized records, kept in Enfants Nature Nature’s computer systems under reasonable security conditions, will be considered as proof of communications, reservations and payments made between the customer and Enfants Nature. Documents are archived on a reliable and durable medium that can be produced as proof.

The customer must inform themselves of the level of physical and sporting difficulty of the outing they wish to book. This information is available on theEnfants Nature website. In case of doubt, a phone call to theEnfants Nature office may be appropriate. A minimum level of physical fitness is required to take part in activities. Depending on the services offered, certain prerequisites are necessary. These are defined in the technical data sheets on theEnfants Nature website. There must be no medical contraindication to the chosen activity.

Enfants Nature is insured against public liability for all the activities it offers, and cannot be held responsible for activities booked through other providers. However, we strongly advise all participants to take out civil liability and/or personal accident insurance for water and mountain sports. Outdoor activities take place in a specific “high-risk” environment. Given the specific nature of the activities on offer, all participants are aware that they may run certain risks due to the hazards and unpredictability of the water and mountain environment. He/she assumes these risks in full knowledge of the facts, and must respect the rules of caution and follow the advice given by professionals. In the event of damage to the equipment used, the participant/customer may be required to pay compensation for wear and tear or full reimbursement, depending on the extent of the damage caused.
  • If the cancellation is initiated by the customer after the reservation payment has been made, the refund will be made by Enfants Nature only in case of force majeure & after receiving proof of this specific case.

  • If the cancellation is at Enfants Nature ‘s initiative: the payment will be fully refunded without any further compensation. There are several possible reasons for cancelling or modifying an outing proposed by Enfants Nature :

    • Weather and climate conditions
    • The technical and physical level or equipment of the participant(s) does not guarantee safety during the outing.
    • Inability of the guide to supervise the outing (illness, accident…)

Rates are those found on the enfantsnature.com website or those displayed on the websites of partners and tour operators at the time of booking. Enfants Nature reserves the right to modify its rates if and when necessary. Enfants Nature accepts the following methods of payment: credit card (online payment), bank transfer, cash. Enfants Nature uses all necessary means to ensure the security and confidentiality of data transmitted on the enfantsnature.com website (including online payment). To this end, this site uses a remote payment system and SSL (Secure Socket Layer) data encryption, which does not share any information over the network. In addition, the transaction is carried out via the Peach Payment – E-payment solutions e-transaction banking platform, which alone has access to the confidential information (card number, validity date) supplied by the customer at the time of payment.

The parties will endeavour to resolve amicably any difficulties that may arise in the performance of the payment contract. In the event of failure to reach an amicable agreement, all disputes relating to the validity, interpretation and performance of this contract shall be governed exclusively by the laws of the Republic of Mauritius. All disputes of any nature whatsoever shall fall within the jurisdiction of the civil and commercial courts of Mauritius, including those ruling in summary proceedings. The French and English versions of this document are the only authentic versions.
